Details of New rules for Huroob 2022: First thing we need to know is When Qafeel can set Horoob on your Iqama

Most important thing is Kafeel can only set Huroob on valid Iqama. if your iqama is expire Qafeel can't set haroob. 

In order to set Huroob, the company or Kafeel always have to write a official letter to proper authorities. and you have right to file a case against your Kafeel if he set Huroob on an expired Iqama. The time period for filing a case is 15 days.


Reasons of the Huroob.

Huroob is set by Kafeel or company for certain reasons. Once a case is filed all the possible reasons are brought to light. For example, 

* If expatriates worker is continusly absent on duty. 

* Leaving Kafeel without any proper notice.

and many more simillar reason 

If Kafeel want to cancel Huroob within 15 days after set the huroob then Kafeel can cancel Huroob online. But if Kafeel didn't cancel within fifteen days then Kafeel needs to visit Jawazat personally to cancel Huroob. 

According to new rules for Huroob 2022, upon resuming work for the same company that set Huroob, another Huroob cannot be set for 2 years.

The Saudi Arabia Ministry of Human Resources and Social Development (MHRSD) in has issued a circular revealing the possibility of canceling the reports of Absent from work (Huroob) registered on expat workers without the need for approval from employer who registered it.

the Undersecretary for Labor Affairs, Abdul Majeed Al-Rashudi, has issued a circular, referring a number of conditions regulating the cancellation of the Huroob (Absent from Work) report on expat’s iqama, one of which must be met in the facility where the worker is registered.

It has been clarified that Hurub may cancel the without permission of the sponsor or company subject to the following conditions.

* If the company is in red status and does not commit to wage protection system at 80% of its total workforce.

* If the company is in red status of Nitaqat and has not committed to documenting its employment contracts at a rate of not less than 75% of its total employment.

* If the status of the company is under procedure and the employer has not opened another file for it within a period of not more than 30 days from the date of placing the file.

* The circular included a number of conditions that must be met by the company wishing to transfer worker’s services

* If the facility or company is not existing or not in place.

* The existence of an electronically certified letter in which the employer who wishes to transfer the worker’s services to him is obligated to bear all the fees incurred by the worker.

File a case

If above mentioned conditions anot applicable for you and you file a case against your Sponsor/Company of Kafeel, on that condations You and Kafeel will have to visit Maktab Amal office and asked to negotiate with each other. If negotiation is successful it is Kafeel’s responsibility to make a new Iqama and arrange a duplicate Kafala within 15 days. Kafeel cannot interrupt the progress. Before you file a case ensure that you have evidence. Spoken words will be of no use. Try to provide hard evidence that proves Huroob was set mistakenly. This way case decision will be in your favor.

How to File Case

As-per the new rules for Huroob 2022 allow Expatriates workers to file a case in two ways. 

* Online.

* Maktab Amal office Which is available outside Jawajat office.
